The constitutional amendment to ban gay marriage that the Center for Arizona Policy is peddling for 2006 allows unmarried couples to beat each other up … SERIOUSLY.

Protect Marriage Arizona is based on a recently passed Ohio initiative that has been under some scrutiny by the courts recently including a recent ruling that—- WAIT FOR IT—- says the initiative prevents unmarried couples from protections against domestic violence.

Let me translate that for you in terms you might better understand: No Ring, No Ceremony, No Reason Not to Hit.

Yeah, pretty jacked up.

DAYTON | County prosecutors cannot charge some unmarried people under Ohio’s domestic violence law because it conflicts with the state constitutional amendment banning gay marriage, this area’s state appeals court ruled Friday.

The 2nd District Court of Appeals is the first of the state’s 12 appellate courts to rule that the domestic violence law runs afoul of the Defense of Marriage amendment, passed by voters in 2004, and does not apply to “a person living as a spouse.”

This whole thing will probably have to be decided by the Ohio Supreme Court and is even FURTHER evidence that these initiatives dangerously overreach.

[UPDATE] – The AZ Republic is reporting this morning that CAP is having a really hard time getting their signatures to make the ballot. They say it is because people are complacant that this initiative will pass easy, the opponents at Arizona Together point to the fact that the Gay Marriage amendment actually screws over WAY MORE PEOPLE than it is initially intended to screw over – making it unpopular.
